EDUCATION AND EXPERIENCE:
Bachelors Degree
Three years professional experience developing and implementing employer-based compliance, accommodation and/ or integrated absence management programs mandated by Federal and State laws
High School Diplomas and college/university degrees must be obtained from an accredited program or university approved by the United States Department of Education and the Texas Education Agency.
PRIMARY PURPOSE SUMMARY:
Provides leadership and guidance in the administration and implementation of the Americans with Disabilities Act (ADA), Sections 503 and 504 of the Rehabilitation Act of 1973, Family Medical Leave Act and other federal and state laws and regulations pertaining to employees and applicants with disabilities.
ESSENTIAL REQUIREMENTS AND RESPONSIBILITIES:
1. Ensures District employment practices, including but not limited to: programs, policies, job application procedures, advancement and other terms or conditions of employment, are in compliance with the ADA.
2. Oversees the District’s ADA and Integrated Leave Management Programs.
3. Serves as the primary point of contact for ADA compliance, including requests for reasonable accommodation for qualified individuals with a disability.
4. Ensures the appropriate interactive process is in place to provide for the prompt and equitable resolution of requests, complaints and inquiries from District employees and applicants regarding accommodations, discrimination and non-compliance under the ADA and other applicable federal and state laws on the basis of disability.
5. Evaluates medical restrictions for employees returning to work from a leave of absence (LOA) to determine appropriate accommodations, transitional duty services and/or other course of action.
6. Develops and implements internal measures and reports which inform the District administration of the status of ADA compliance and opportunities for people with disabilities.
7. Responsible for the preparation and maintenance of all documentation related to accommodation requests for record keeping purposes and in response to case information requests from agencies, including the Equal Employment Opportunity Commission (EEOC).
8. Works with agencies and vendors that provide services to individuals with disabilities.
9. Tracks and evaluates budgetary expenditures for physical and/or program access requirements of the ADA, which may include building modifications and/or equipment purchases.
10. Assists in the development and maintenance of job descriptions to ensure the requirements, physical and mental demands and duties comply with the requirements of ADA.
11. Develops and maintains written materials and other informational pieces to broadly disseminate regarding the ADA and the District’s policies relating to persons with disabilities and qualified leaves of absence.
12. Maintains current information regarding state and federal laws and regulations as well as the best practices concerning the rights of persons with disabilities and ways of providing reasonable accommodations to persons with disabilities while maintaining program performance standards.
13. Designs and conducts ADA awareness, interactive process, and LOA training for supervisors and staff.
14. Ensures the timely filing of all required compliance reports.
15. Maintains confidentiality of information.
16. Reports to work on time every day.
17. Performs additional duties and accepts other responsibilities as may be assigned.
QUALIFICATION REQUIREMENTS:
• Knowledge of the provisions of Titles I, II, and III of ADA and other laws addressing the rights of people with disabilities
• Knowledge of practices and activities covered by employment non-discrimination requirements of ADA
• Knowledge of the EEOC, Family Medical Leave Act and leave of absence regulations and policies
• Knowledge of various alternative formats and technologies that enable people with disabilities to communicate, participate, and perform tasks
• Ability to work cooperatively with people with disabilities
• Ability to establish trust and rapport with applicants and employees
• Demonstrated skills and training in conflict resolution/mediation
• Demonstrated ability to communicate effectively using verbal and written skills
• Demonstrated ability to respond effectively to the most sensitive inquiries or complaints
• Demonstrated ability to use good judgment and discretion in sensitive, confidential issues and projects
• Valid Texas Drivers License with a driving record that meets the requirements of the District
PHYSICAL DEMANDS:
The physical demands described here are representative of those that must be met by an employee to successfully perform the essential functions of this job. While performing the duties of this job, the employee is regularly required to talk and hear, operate a computer and other office machinery for prolonged periods of time. The employee is frequently in a stationary position. The employee occasionally stands and moves about the office and positions self to access files and office machinery. The employee must be able to detect, identify, inspect and assess their work and their workspace. The employee must occasionally lift and/or move up to 25 pounds. The employee is occasionally required to drive personal vehicle in the performance of assigned tasks.
